Dog Bite: Trained Attack Dogs and Civil Code 3342

There are extreme circumstances where one is attacked by a dog who is specifically trained to fight and attack.

You’ll remember that Michael Vick, who is still a quarterback for the NFL, was involved in a ring of dogs trained to fight for sport. So, if you’re attacked by a dog who is trained to attack, it is very likely you are going to be entitled to punitive damages, and punitive damages are not covered by insurance.

Whenever a dog has bitten at least once in the past, we file claims for punitive damages unless our client directs us not to do so (for example with a friend or family member), because once a dog has a known propensity for biting, clawing, attacking, et cetera, the owner must take extraordinary precautions to protect the public.
