Absolutely! You can bring a civil case for domestic violence or sexual assault if there is no criminal case. Our firm has received large settlements and jury awards in cases where the police were never involved and in cases where there may have been an arrest, but no criminal prosecution, and even in cases where a criminal prosecution resulted in the perpetrator being found not guilty.
The civil proceeding is entirely separate, and one may pursue a civil proceeding regardless of whether there was a criminal case, and regardless of the outcome of any criminal case.
