Dog Bite Cases: Statute of Limitations

If you are suing a private party, the statute of limitations is two years from the date of the bite. With a government entity, such as the circumstance of when you are bitten by a police dog, you must file a government claim within six months.

Normally after you file a government claim, the governmental entity may reject your claim within 45 days and that triggers your obligation to file a lawsuit in superior court within six months of the date of rejection.

It is critical that a dog bite victim contact our office as soon as possible so that we are able to identify all potential defendants and make sure that claims are timely filed, and so that we may identify applicable insurance policies and preserve evidence.
