If a client comes to me with a spinal cord injury, I ask them a lot of questions about their medical history to determine if they may have had a preexisting condition to their cervical, thoracic or lumbar spine, and I will ask them very detailed questions about how the collision or the trauma occurred such as how was their body positioned immediately before the injury, and how their body moved as a result of the violent impact.
Those questions as well as a review of property damages reports and photographs from the accident scene will tell me a lot about what I need to do in order to prove that my client’s spinal cord injury (neck or back), was directly caused by the conduct of the defendant.
